Cashmanila Privacy Agreement

1. Introduction

The Company "CASHMANILA LENDING INVESTORS, INC." operates under the platform "Cashmanila" and values the privacy of our customers and users across our online platforms, including our mobile application. This Privacy Policy ("Policy") describes the information “Cashmanila” collects about you and how we use and share that information. This policy applies to information we collect when you register with “Cashmanila”, access or use our mobile applications, products and services, or when you otherwise interact with us.

Before clicking to accept this agreement, you should read this agreement carefully. Make sure you have read and fully understood each chapter.

By accessing and using the services provided by this application, you are deemed to have read and agreed to obtain personal information from your device through this application.

2. Definition

Unless otherwise defined, all capitalized terms used in this Privacy Policy shall have the same meanings ascribed to them in our Terms of Use (as applicable).

3. Collection of Personal Information

We collect certain Personal Information about you. The Personal Information that we collect may be provided by you directly (for example, when you open an Account to use the Service via App, or you otherwise provide Personal Information to us) or by third parties, or be collected automatically when you use the App. We may collect information in various forms and for various purposes (including purposes permitted under Applicable Law).

3.1 When you register an account

When you register for the Service, we will collect your information such as emergency contact, SIM card details, financial and credit information (including your Mobile Money Account details, bank account details)

3.2 When you use the App or visit our Website

Whenever you use the App or visit our Website, we may collect certain technical data concerning your usage, such as internet protocol (IP) address, information as webpages previously or subsequently viewed, duration of every visit/session, the internet device identity (ID) or media access control address, and also information regarding the manufacturer, model, and operating system of the device that you use to access the App or our Website.

3.3 Collection of information from third parties

Due to the nature of the Services that we provide, we are required to work with a number of third parties (including Credit Reference Bureaus, Banks, Mobile Network Providers, Collection Agencies, our Agents, Vendors, Suppliers, Contractors, Partners and any others who provide services to us, perform functions on our behalf, or whom we collaborate with) and we may receive information about you from them. In such cases, we will only collect your Personal Information for or in connection with the purposes for which such third parties are engaged or the purposes of our collaboration with such third parties (as the case may be), provided that we have taken reasonable steps to ensure that such third parties would undertake to us to obtain your consent for the disclosure of your Personal Information to us in line with this Privacy Policy and Applicable Law.

3.4 Access other permissions with your consent

Mobile Phone (Device Information)

We will use your device information and phone's code (IMEl) because with it we can prevent fraud by ensuring that other phones cannot replace you when requesting a loan.

SMS

We will only collect financial SMS from your inbox, which helps us identify the various accounts that you are holding and the cash flow patterns that you have as a user to help us perform a credit risk assessment, which enables us to determine your risk profile and to provide you with the appropriate credit analysis to enable you to take financial facilities from the regulated financial entities and other service providers available on the platform.

The SMS data is encrypted via HTTPS and uploaded to our server. We will delete the SMS information after we have determined your risk profile.

Installed Apps

We will collect a list of the installed applications metadata information which includes the application name, package name, installed time, updated time, version name, and version code of each installed application on your device to assess your creditworthiness and enrich your profile with pre-approved customized loan offers.

These data will be encrypted via HTTPS and uploaded to our server. We will never share this data with third parties.

Location

We will access your GPS-based location information to determine whether you are within the scope of our services and use this as a basis to recommend better loan products and services to you.

Storage

We require the storage information permission that allows the App to enable you to upload photos and/or documents to complete the application form during your loan application journey.

Camera

We require the camera information permission to provide you with an easy/smooth experience and to enable you to click photos of your KYC documents along with other requisite documents and upload the same on the App during your loan application journey.

Directory:

We require access to your device's directory or contact list to assist in the verification process and to ensure the accuracy of your loan application. This access allows us to cross-reference your contact information with the details provided in your application, facilitating faster and more efficient verification procedures. Protecting your privacy and maintaining the confidentiality of your data is our top priority.

Calendar:

Access to your device's calendar is necessary for scheduling loan repayment reminders and notifications. By syncing with your calendar, we can provide timely reminders about upcoming loan repayments, helping you manage your finances more effectively and avoid missing payments. We respect your privacy and assure you that calendar data will only be used to provide these reminders within the app. We do not share this information with any external parties unless required by law or with your explicit consent.

4. Use of Personal Information

a. to identify you and to register you as a user and to administer, manage, or verify your Account and your credit conditions as such.

b. to communicate with you and to send you information in connection with the use of the App.

c. to facilitate or enable any checks as we may in our discretion, consider necessary before we register you as a user.

d. to disburse Loans and collect payments for your use of the Service.

e. to build credit models and perform credit scoring.

f. to contact you by telephone using auto-dialed or pre-recorded message calls or text (SMS) messages (if applicable) as authorized for the purposes described in this Privacy Policy and the Terms of Use.

g. to comply with Applicable Laws, regulations, and rules, such as those relating to “know-your-customer” and anti-money laundering requirements.

h. to send you direct marketing communications and information on special offers or promotions.

i. to notify you of any updates to the App or changes to the Service (including interest rate, Transaction Fees, etc.) available.

j. to process and respond to enquiries and feedback received from you.

k. to maintain, develop, test, enhance, and personalize the App to meet your needs and preferences as a user.

l. to monitor and analyze user activities and demographic data including trends and usage of the Service available on the App.

5. Retention of Personal Information

We will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. You have the right to request deletion of the data we have collected about you. However, we will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer periods.

You may opt-out from receiving such marketing communications at any time by clicking on any “unsubscribe” facility embedded in the relevant message, or otherwise contacting us using the contact details stated below. Please note that if you opt-out, we may still send you non-promotional messages, such as Loan disbursement or repayment receipts, or information about your Account or the App.

11. Limitations of Liability

You expressly understand and agree that we, including our directors, officers, employees, representatives, or the service provider, shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from:

a. use or the inability to avail the Services.

b. unauthorized access to or alteration of your Personal Information.

c. inability to use the Platform.

d. failure or delay in providing the Services or access to the Platform.

e. any performance or non-performance by us.

f. any damages to or viruses that may infect your electronic devices or other property as the result of your access to the Platform or your downloading of any content from the Platform and server failure or otherwise or in any way relating to the Services.

12. Changes to this Privacy Policy

We may review and amend this Privacy Policy at our sole discretion from time to time, to ensure that it is consistent with our future developments, and/or changes in legal or regulatory requirements. If we decide to amend this Privacy Policy, we will notify you of any such amendments by means of a general notice published on the App and/or Website, or otherwise to your e-mail address set out in your Account.
